360S Projects terms of use
These Terms govern access to 360S Projects websites, content, calculators, planning tools and related services (the “Services”). By creating an account or using the Services, you agree to these Terms together with the Member Service Terms, Member Privacy Notice and applicable website disclaimers.
1. Educational and preliminary information
The Services provide general educational information and preliminary planning support. They are not professional engineering, architectural, regulatory, safety, legal, financial or other specialist advice. Outputs do not constitute a certified design, specification, tender document, compliance approval or instruction to construct, procure, operate or maintain a facility.
You must appoint appropriately qualified professionals and independently verify dimensions, calculations, loads, air-change rates, pressure relationships, quantities, product selections, prices, standards, codes, manufacturer data, site conditions and statutory requirements before relying on any output.
2. No warranty
To the fullest extent permitted by law, the Services are provided on an “as available” basis. 360S Projects does not warrant that content or outputs are complete, current, accurate, fit for a particular purpose, uninterrupted, secure or free from errors. Standards, regulations, product data and market conditions may change without notice.
3. Accounts and acceptable use
You must provide complete and accurate account information, keep credentials and one-time codes confidential, and promptly report suspected unauthorised access. You must not share accounts, bypass controls, test vulnerabilities without written permission, upload malicious material, interfere with the Services, scrape at harmful scale, misrepresent an affiliation or use the Services unlawfully.
4. Intellectual property and user material
Unless stated otherwise, the Services and their original content, interface, branding and software are owned by or licensed to 360S Projects. Your account gives you a limited, revocable, non-transferable right to use the Services for lawful internal, educational and professional evaluation purposes. You retain ownership of material you submit and grant 360S Projects the limited rights reasonably needed to host, process, secure, back up and display it to you.
5. Third-party services and links
The Services may depend on hosting, email, analytics, mapping, product, supplier or other third-party services. 360S Projects does not control and is not responsible for third-party content, availability, security, terms or acts. Use of third-party services may be subject to separate terms.
6. Suspension and termination
360S Projects may restrict or suspend access where it reasonably suspects compromised credentials, abnormal or harmful activity, false registration information, breach of these Terms, risk to another user or the platform, or where required by law. The Member Service Terms explain the account-control process.
7. Limitation of liability
“Associated Parties” means the service provider’s owners, directors, officers, employees, contractors, agents, contributors, licensors, suppliers, hosting providers, technology providers and affiliated service providers.
To the fullest extent permitted by applicable law, 360S Projects and its Associated Parties will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss, or for loss of profit, revenue, opportunity, business, goodwill, anticipated savings, data, availability or production arising from or connected with the Services. This includes loss arising from reliance on calculations, planning outputs, product information, member content, email delivery, security events, service interruption or third-party services.
To the fullest extent permitted by law, the combined aggregate liability of 360S Projects and its Associated Parties for direct claims arising from the Services during any twelve-month period will not exceed the greater of RM100 or the fees actually paid by the claimant for the affected Service during that period.
Nothing in these Terms excludes or limits liability for fraud or wilful misconduct, death or personal injury where exclusion is prohibited, statutory consumer rights, or any other liability that cannot lawfully be excluded or limited. Any exclusion or limitation that is not enforceable will apply only to the maximum extent permitted by law.
8. Indemnity for misuse
To the extent permitted by law, you are responsible for loss, claims or reasonable costs caused by your unlawful use of the Services, infringement of another person’s rights, malicious material, unauthorised account sharing or material breach of these Terms. This provision does not make you responsible for loss caused by 360S Projects or its Associated Parties.
9. Changes, governing law and contact
360S Projects may update the Services and these Terms. Where a material new version requires acceptance, member access may be paused until the current version is accepted. These Terms are governed by the laws of Malaysia, and disputes are subject to the courts of Malaysia, without limiting rights that applicable law requires to be available elsewhere.
